Leisure Choice Gift Card Terms and Conditions

These Terms and Conditions (“Agreement”) apply to the purchase and sale of the Leisure Choice Gift Card (hereinafter referred to as the “Gift Card”). Please read these Terms and Conditions carefully as they constitute a legal contract between you and Virgin Experience Gifts Inc. (“us,” “we,” or “our”). By using the Gift Card, you agree to be bound by the terms outlined herein.

Definitions

  • “Gift Card” refers to the Leisure Choice Gift Card issued by Virgin Experience Gifts and distributed by us.
  • “You” and “your” refers to the commercial customer who purchases a Gift Card from us pursuant to the terms of this Agreement.
  • “We”, “us” or “our” – refers to Leisure Choice, a trading name of Virgin Experience Gifts Inc., a Florida corporation, located at 228 Park Ave S, PMB 45957, New York, NY 10003-1502 US
  • “Website” refers to the website located at www.leisurechoice.com

Leisure Choice Gift Card

  • The Gift Card is a prepaid payment card that can be used to purchase from a selection of branded gift cards on the Website. A comprehensive list of participating brands can be found on our Website. Please note that the Gift Card cannot be used directly with the retailers and must be swapped at leisurechoice.com.
  • We update our list of participating brands on a regular basis but are unable to guarantee that the list is accurate and complete. We reserve the right to withdraw or change the range of brands available at any time and without prior notification.
  • The Gift Card has no expiration date. However, the promotional balance on certain cards may be subject to expiration, which will be clearly indicated during the purchase process.
  • The Gift Card is not a credit card and is not linked to your bank account in any way. Funds held by us on your behalf are not considered deposits, and you will not earn any interest on the funds loaded on a Gift Card.

Purchasing, Loading, and Activating Your Gift Card

  • Gift Cards can be purchased via our B2B team who can be contacted via www.virginexperiencegifts.com/corporate.
  • The Gift Card is loaded with funds at the time of purchase. You can load additional funds onto a Gift Card by contacting our Customer Service team at the email address set forth above.
  • Upon accepting an order, we shall deliver the requested number of Gift Cards via one of the following methods, as per your designation: (a) electronically by e-mail, either to you for subsequent resale or redistribution or to your individual recipients directly, or (b) other mutually agreed upon delivery method. For electronic delivery directly to individuals, you shall provide us with only such individuals’ names and e-mail addresses. In no case shall you provide us with any other identifying information regarding such individuals, including their mailing addresses, ZIP codes, telephone numbers, or other personal information unless we are required by law to obtain such information.

Using Your Gift Card

  • Gift Cards shall be delivered to you (or to the recipients) fully activated. The following terms will apply to the redemption and use of the Gift Cards.
  • We do not disclose to you any data, information, or other details regarding the redemption or use of Gift Cards by individual recipients following resale or redistribution by you.
  • A Gift Card can be only be used by the recipients to purchase branded gift cards at the Website as set forth below:
    • Recipient will visit the Website.
    • Recipient will select Redeem Gift Card.
    • Recipient will select their chosen branded gift card from those available (“Branded Gift Card”) and add this to checkout.
    • Recipient will enter their details including email address to receive their link to obtain their Branded Gift Card.
    • Recipient will enter the Gift Card as payment for their chosen Branded Gift Card
    • Recipient will be emailed a SecureLink by our third party service provider (see below for information and terms relating to use of SecureLink) entitling the Recipient to obtain their Branded Gift Card to be redeemed with the relevant retailer.
    • The Recipient must have sufficient funds available on the Gift Card to purchase their Branded Gift Card and any remaining funds on the Gift card will remain the Gift Card.
  • We recommend Recipients should check their Gift Card balance via the Website.
  • Some retailer redemption options may be subject to limitations, including specific validity periods or exclusive in-store or online redemption requirements. Please note that these restrictions are beyond our control. However, we provide information for each retailer including a link to their terms and conditions (if they have an online reference to their specific gift card terms).
  • Once a Recipient has confirmed their chosen Branded Gift Card, it is not possible to cancel so Recipients should check carefully before confirming their purchase.
  • Once the Recipient has purchased their chosen Branded Gift Card they are bound by the terms and conditions of that brand.
  • We reserve the right to suspend, restrict, or cancel a Gift Card at any time. We may refuse to issue or replace a Gift Card if we suspect unauthorized or fraudulent use, if you do not comply with these terms and conditions, or in exceptional circumstances that impede the normal operation of the Gift Cards.

Cancellation And Refund Process

    Gift Card purchases are final. Gift Cards cannot be returned or refunded for cash unless required by applicable law. Further, we do not provide refunds for any Gift Card that has been received (either via email or otherwise) by a recipient. We do not provide any refund for any Branded Gift Cards selected by recipients.

    In the event of cancellation of an order made with the Gift Card, any refunds will be credited back to the original Gift Card.

    Lost or Stolen Cards

    • You shall implement commercially reasonable security measures to ensure proper safekeeping and issuance of the Gift Cards in accordance with this Agreement.
    • We are not responsible for lost or stolen Gift Cards. Treat the Gift Card like cash, and safeguard it accordingly.
    • Report a lost or stolen Gift Card immediately to Leisure Choice Customer Support by contacting us through the contact information provided on the Website.

    Changes to These Terms and Conditions 

     

    • We reserve the right to amend this Agreement at any time. The most recent version will always be available on our Website. Your continued use of the Website or purchase of Gift Cards means that you accept and agree to any changes. You are expected to check this Agreement on the Website frequently to learn of any changes, as they are binding on you. If you do not agree to the changes, you will not be entitled to purchase a Gift Card and must immediately stop using the Website to purchase Gift Cards.

    Privacy

     

    • The use of the Gift Card is subject to the Leisure Choice Privacy Policy which can be found on the Website. This sets out how we will manage and process any personal data you share with us.

    Complaints

     

    • If you have concerns or complaints regarding your Gift Card or its management, please contact Customer Services for investigation. We will address your complaints promptly and fairly.

    Our Liability to You

     

    DISCLAIMER OF WARRANTY. We make no representations or warranties of any kind, whether express or implied, regarding the Gift Cards or any other matter, including without limitation, the merchantability, suitability, originality, fitness for a particular use or purpose of the Gift Cards, and we hereby specifically disclaim the same. You shall not rely on any oral or written representations or warranties on the part of any other agent of Virgin Experience Gifts. No trade usage or prior course of dealing will be used in the interpretation or construction of the terms and conditions set forth herein.

    Limitation of Liability. In no event are we (or our third party service provider) liable for any punitive, special, incidental, indirect or consequential damages of any kind whether foreseeable or not, arising out of, or in connection with, your resale or distribution of the Gift Cards even if we have been advised of the possibility of such damages. Our (or our third party servicer provider’s) aggregate liability relating to or arising out of this Agreement, whether such liability is asserted on the basis of contract, tort, or otherwise, is limited to the amounts you paid to us under this Agreement during the consecutive 12-month period preceding the date on which any such claim is asserted.

    Indemnification

     

    To the fullest extent permitted by law, you agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including attorneys’ fees) arising out of or relating to your violation of this Agreement or your use of the Website, including any content provided by you, your use of any information obtained from the Website, your violation of any law or regulation and infringement by you of any intellectual property or other right of any person or entity.

    Other Important Terms 

     

    These Terms and Conditions are governed by the laws of the United States and the State of [Florida]. Any disputes will be subject to the exclusive jurisdiction of the courts in the State of [Florida].

    The parties acknowledge and agree that their relationship is that of independent contractors and neither you nor your agents, representatives or employees will be considered employees of ours. Nothing set forth herein will be construed to place the parties in the relationship of partners or joint venturers and neither party will have any right or power to obligate or bind the other in any manner whatsoever except as authorized in this Agreement or otherwise specifically authorized in writing.

    If any of the terms of this Agreement are or become illegal or unenforceable, such terms will be null and void and will be deemed deleted from this Agreement, and all the remaining terms of this Agreement will remain in full force and effect.

    No waiver of any provision of this Agreement, nor consent to any departure by either party therefrom, will in any event be effective unless the same will be in writing and signed by a duly authorized officer of the party to be charged with the waiver or consent, and then such waiver or consent will be effective only in the specific instance and for the specific purpose for which given.

    You may not assign or transfer any of your rights or obligations under this Agreement without our consent. Any attempt to assign or transfer in violation of the previous sentence will be void in each instance. We may, without your consent, freely assign and transfer any of our rights or obligations under this Agreement. This Agreement will be binding on, inure to the benefit of, and be enforceable by you and us, our assigns and your permitted assigns.

     

    SecureLink Terms

    1. What do these terms cover?

    These terms (“Terms”) govern your receipt and use of the Tillo SecureLink received on exchanging your Virgin Incentives Gift Card for a Branded Gift Card.  By clicking on the Tillo SecureLink you will be directed to revealyourgift.com where you can use your Tillo SecureLink to claim your gift card from the relevant retailer (“Retailer”) to the value of the SecureLink. The revealyourgift.com domain is owned and operated by Reward Cloud Limited trading as Tillo (Company no. 10051136) (“we”, “our”, “us”, “Tillo”).

    By using the Tilo SecureLink you confirm that you accept these Terms as amended from time to time and that you agree to comply with them. If you do not accept these Terms, You should not use the Tillo SecureLink. 

    We do not guarantee that access to revealyourgift.com will always be available or be uninterrupted. We therefore recommend claiming your Retailer gift card in a timely manner prior to the Tillo SecureLink expiry date. We may suspend, withdraw, discontinue or change all or any part of the Tillo SecureLink without notice but if we do so will provide an alternative means of using your Tillo SecureLink value.

    We are the owner or the licensee of all intellectual property rights in the Tillo SecureLink and in the materials displayed via the Tillo SecureLink. Those works are protected by copyright laws and treaties around the world and may not be used without our permission. All such rights are reserved.

    We recommend that you keep a copy of these Terms for future reference. These Terms are only available in English.

    1. How can I use the Tillo SecureLink?

    You will have received a communication with the key details of how to use your Tillo SecureLink to claim a Retailer gift card including any additional terms set by the Retailer (such as a maximum redemption value, or the type of products you can obtain using your Retailer gift card). Please check all details carefully before using your Tillo SecureLink.

    The Tillo SecureLink has an expiry date after which it cannot be used. The expiry date of the Tillo SecureLink will be displayed on the Tillo SecureLink. We will not replace any Tillo SecureLink or refund any Tillo SecureLink value should it expire before it is used to claim a Retailer gift card. If your Tillo SecureLink has expired you can email reactivations@revealyourgift.com to request reactivation of your Tillo SecureLink.

    Retailer gift cards obtained using the Tillo SecureLink may also be subject to a separate expiry date, as determined by the relevant Retailer. This will apply to your use of the Retailer gift Card and will be detailed on the Retailer gift card.

    Once the Tillo SecureLink has been used to claim a Retailer gift card, the Retailer gift card can not be cancelled and the value cannot be transferred back onto the Tillo SecureLink or otherwise refunded.

    The Tillo SecureLink received by you may only be used by you for your own personal use and not for any commercial purposes.

    We reserve the right to refuse to accept and may cancel any Tillo SecureLink which we believe has been stolen, duplicated, tampered with or is being used fraudulently or is otherwise suspected to be affected by fraud. 

    1. I have an issue, should I contact the Virgin Incentives or the Retailer?

    If your Tillo SecureLink is taking longer than expected to process or you have any other problems using your Tillo SecureLink, you should contact Virgin Incentives to check the status of your Tillo SecureLink.

    The relevant Retailer is responsible for all matters related to its gift cards including (without limitation) communicating any additional terms related to obtaining the gift card or its use such as maximum redemption value, prices, taxes and delivery costs. All queries related to any Retailer gift card should be directed to the relevant Retailer.

    1. Do we process any of your personal data?

    We have provided the Tillo SecureLink to you on behalf of Virgin Incentives and act as a data processor on behalf of Virgin Incentives as data controller. We will use your contact details provided during checkout to deliver the Tillo SecureLink to you. 

    If you contact us with a query, we will usually collect your name and contact details, because it’s in our legitimate interest to make sure we can properly respond to your query.  We may inform Virgin Incentives that you have contacted us and the nature of your query and any steps taken to address that query.   

    We will only retain your personal information for as long as we need it to provide our services to Virgin Incentives unless we are required to keep it for longer to comply with our legal, accounting or regulatory requirements. We may collect anonymised information about your use of your Tillo SecureLink. We use this information to improve our services and to better understand how people use our services.

    We store your data in the European Union, primarily in the Republic of Ireland. Whenever we transfer your personal information outside of the UK and the EU, we ensure it receives additional protection as required by law. You can contact us at privacy@tillo.io for more information.

    1. What other terms apply?

    We reserve the right to amend or waive any provision of these Terms from time to time.  The Terms applicable to the use of the Tillo SecureLink shall at any time be the terms and conditions accessible via your Tillo SecureLink.

    These Terms constitute the entire agreement and understanding between us and you with respect to your use of a Tillo SecureLink.

    Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms will not be interpreted as a waiver of our rights or remedies.

    We may transfer the benefit of these Terms to any other company in the same group of companies as us. If we assign the benefit of these Terms and Conditions, your rights will not be affected.

    If a court invalidates any part of these Terms, the rest will still apply. If a court or other authority decides that some of these Terms are unlawful, the rest will continue to apply.

    These Terms are governed by English law. Wherever you live, you can bring any claim against us under these Terms in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring any claim against us in the courts of the country you live in. If you live in Wales, Scotland or Northern Ireland, we can claim against you under these Terms in the courts of the country you live in.  All other claims will be brought by us in the English courts.
